The trial of
Charles Goslaw for the murder of Adam Grant is progressing before a jury
in Judge Belden's Court. The defendant testified in substance as follows: He
was a house-mover; he had a family; wife and two children living in Los Gatos;
was not a partner with Mr. Grant when this happened; the tools then belonged to
Mr. Brown, and Mrs. Brown was to give three or four days notice to witness when
he wanted the tools. When my brother told me
that Grant had sent back the rollers, I told him I wanted to see Mr. Grant to
find out why he had moved the tools so suddenly; was not angry. I did not say
"I will not hurt him, oh, no!" [I] said, "I would not stay long;" he was a
friendly visitor at our house. I said, "I came up for tools." He said, "You
did;" he then grabbed the knife from the table from behind him saying:
"G-------- d-------- you," and started toward me. I jumped to one side, and
shoved him away two or three feet, then backed against the door and shut it;
had to defend myself. I hit him and he fell against the stove. I intended
backing out of the door instead; I shut it. I was not intoxicated; took last
drink about 6 o'clock in San Jose; I had no malice and made no threats; I had
two cuts on my hand; could not say how I got them; the scars are here
now. Mr. Grant asked me for work in moving the
church; I refused, as I thought brother and I could do it; was arrested once at
Los Gatos for putting a stove out of my own house; the case was dismissed.
After the trouble at Grant's I went down town and gave myself up to Constable
Reynolds; I stopped at home that night; Mr. Reynolds let me go without being
watched; he came next morning about 8 o'clock. Arguments were made by the District Attorney for the
People and W. B. [J. H.] Hill for the defense this morning. The case was given
to the jury at 11:45 o'clock. At 2:30 o'clock
this afternoon the jury brought in a verdict of murder in the first
degree. The penalty was not fixed and Judge
Belden will be compelled to pass the sentence of death upon Goslaw on Friday
next at 10 o'clock A. M.
