Sonoma Tax Collector to James McReynolds

 

Conveyance of Real Estate - sold for the non-payment of State and County Taxes - -

This Indenture, made and entered into this 26th day of May in the year of our Lord one thousand eight hundred and eighty eight (A.D. 1888.) Between E. P. Ceolgan Tax Collector of the County of Sonoma State of California, party hereto, of the first part and James McReynolds of Sonoma County part hereto of the second part. Witnesseth, That whereas J. L. Dimwiddle, here to for and, at the time of the levy and publication hereinafter spoken of, was Tax Collector of the County of Sonoma, by virtue of and in conformity with Title IX of Part III of the Political Code, of the State of California, approved March 12, 1872, - and put into effect by an act of the Legislature, of the State of California, entitled "An Act to put into immediate effect certain pars of the Political and Rural Codes" approved March 16, 1872, did, on the third Monday in January 1879, deliver to the Auditor of said County a complete "Delinquent List" of all persons, and property then owing taxes in said County to the State of California and the County of Sonoma together with the costs and charges due thereon; which said "Delinquent List" did include the property first hereinafter given in this certificate, that the said property was assessed for the fiscal year commencing on the first Monday in March 1878, for State and County Taxes at $3.57 to Spring Hill Church that the property assessed, lived upon and amortized, situate, lying and being with the County of Sonoma, and described thus: Lot on Spring Hill known as Spring Hill Church, Analy Township and the least quantity, or smallest portion of said property was by the said Tax Collector as aforesaid - on the 8th day of March A.D.1879, in accordance with law, offered for sale, to pay said Taxes, with the costs, and charges due thereon, at Public Auction, in front of the County Court Here[?] in said County, that at Said auction B. F. Tilton was the bidder who was willing to take the least quantity of or smallest portion of the interest in said land, and pay the taxes costs and charges [?] thereon, which taxes costs and charges including, the fifty cents for the certificate for sale amounted to Four & 18/100 Dollars - that the said least- quantity of, or smallest portion of the interest in said land, lying and being within the County of Sonoma as is hereinafter described, to wit, Lot on Spring Hill, Known as Spring Hill Church Anally Township was by said Tax Collector as aforesaid, struck off to the said (B. F. Tilton who paid the full amount of) taxes - costs and charges, and therefore became the purchaser of the last described piece or parcel of land or sold for said taxes as aforesaid that the said real estate was sold subject to reduption[?], pursuant to the statute in such cases made and provided, and that unless redeemed within twelve months from the date of this purchase, said purchases will hereintitled to a deed as the expiration of twelve months from the date of this sale.

And whereas, no person has redeemed the property aforesaid during the time allowed by law for its redemption, and stated in the certificate of sale therefor that said certificate bears, date of March 8th 1879, the date of said sale. And whereas the said B. F. Tilton has duly assigned his certificate of sale, and all his rights thereunder unto the said party of the second part, as appears from said certificate of sale and assignment thereof and on file in the Tax Collectors' office in said County.

Now Therefore, This Indenture Witnesseth That for and in consideration of the sum of Three Dollars and Fifty Cents to me in hand paid, the receipt whereof is hereby acknowledged, I, E. P. Ceolgans, Tax Collector as aforesaid, by virtue and in pursuance of the statue in such cases made and provided and confirmed and by these present does grant bargain sell, carry and confirm unto the aforesaid James McReynolds, and to his heirs and assigns forever all that lot piece or parcel of land so sold and herewherefore and last described in this deed as fully and absolutely as I, Tax Collector, as aforesaid, may or can lawfully sell and carry the same. Together with all and singular the tenements, hereditaments and appertaining of the said Spring Hill Church of in or to the last above described premises, and every part and parcel thereof with the appurtenances which it had or possessed on the day of said levy or assessment.

To Have and to Hold all and singular the hereinbefore and last mentioned and described premises, together with the appurtenances thereof, unto James McReynolds, the said part of the second part and his heirs and assigns forever.
